Oshiomhole appeal Court Judgment sacking him as All Progressives Congress National Chairman

The National Chairman of the ruling All Progressives Congress(APC), Adams Oshihomole who was sacked from office by a Federal High Court ,Jabi, Abuja, the Federal Capital Territory  has challenged the court ruling, expressing dissatisfaction.

Penpushing reports that, in view of this, Oshihomole and All Progressives Congress(APC) on Wednesday  appealed the judgment, and thereby filed the case at the Appeal Court Abuja Judicial Division with suit number FCT/HC/837/2020.

The respondents in the appeal suit include; Comrade  Mustapha Salihu, Anselm Ojezua, Alhaji Sani Gomna, Oshawo Steven, Hon Fani Wahulabi, Evang Princewill Ejogharado, Inspector General of Police and State Security Service.

Penpushing further reports that   the Notice of Appeal declared that it should be noted: that the appellants being dissatisfied with the decision of the Federal Capital Territory High Court sitting in Jabi((ceram D,Z Senchi) contained in the ruling of His Lordship in suit no: FCT/HC/CV/837/2020 delivered on 4th March, 2020(described in paragraph 2 do hereby appeal to the court of appeal upon the grounds set out in paragraph 3

And take further notice: that the appellants will seek the relief contained in paragraph 4, and that the names and addresses of persons affected by this appeal are set out in paragraph 5. Part of the ruling complained of: the whole ruling granting the 1-6 respondents.

Penpushing recalled that, t Federal Capital Territory (FCT) High Court sitting in Jabi has ordered the suspension of Adams Oshiomhole, as National Chairman of the ruling All Progressives Congress(APC) pending the determination of a substantive suit.

The judge, Justice  Danlami Senchi, gave the order on Wednesday following an application of interlocutory injunction asking the court to suspend him(Oshiomhole), having been suspended as a member of the Edo State Chapter of All Progressives Congress( APC)

Penpushing also reports that, the application was filed by an applicant, Oluwale Afolabi, dated January 16, while Oshiomhole is the first respondent, as well as All Progressives Congress,(APC) as  the second respondent, and the applicant contended that Oshiomhole is currently suspended by the party and has not challenged the suspension.

The applicant argued that, Oshiomhole’s rights as All Progressives Congress( APC) member is currently abated and he cannot continue to act as Chairman of the party,stressing that he( Oshiomhole) cannot continue to enjoy benefits from the party despite his suspension as a member of the party.

The Judge in his Wednesday ruling  held that the first and second respondents wrongfully kept Oshiomhole as the National Chairman of the party, and therefore  ordered that  Oshiomole should stop parading himself as the Chairman of the  ruling All Progressives Congress(APC).

Penpushing also reports that, Justice Senchi,  urged the All Progressives Congress(APC )to desist from acknowledging Oshiomhole  as the Chairman of the party and also ordered not to grant  Oshiomhole access to the party secretariat.

The embattled Oshiomhole, it is recalled was controversially suspended by the All Progressives Congress ( APC)  Edo State Chapter  after he was suspended by the party’s leadership in his ward in the State.

Penpushing reports that, national headquarters of the All Progressives Congress (APC) and Oshiomhole however, discountenanced the suspension, saying it was invalid, stressing that the leadership of the party is the only authority that could suspend national officers of the party including the Chairman.
