Court declares Oba Tejuoso as prescribed authority to appoint coronet traditional ruler in ososun community
The High Court of Justice sitting in Ota Judicial Division of Ogun State has ruled that the Osile of Oke-Ona Egba, Oba Adedapo Tejuoso is the prescribed authority to appoint and installed a traditional head (Baale) in Ososun community located in Ifo local government area of the state.
Penpushing reports that this was contained in a judgement delivered by Justice N.I Agbelu in a suit number HCT/100/2011 following contentious issue on the illegal installation of Chief Hezekiah Solanke (1st Defendant) as coronet Oba of Ososun
The judgement delivered on July 3, 2022 said in view of the oral and documentary evidence by the claimant Chief Taofeek Fashina , he has discharged the evidential burden placed on him and that first defendant(Solanke) has failed to give credible evidence to support his approval by 7th defendant, Oba Samuel Oladipupo(Olu of Ifo)
‘I find and hold that the claimant has been validly elected, appointed and approved as Baale of Ososun by the 6th defendant, the prescribed authority to the chieftaincy. The claimant’s appointment as Baale of Ososun is therefore valid in law’, the judge ruled
‘The contention of the 1st defendant’s counsel that 7th defendant is the prescribed authority for Ososun is not supported by the credible evidence. Issue (11) is also resolved in favour of the claimant’, the judgement reads
‘The power to appoint coronet Oba in the state is vested on the Executive Council under Chiefs Law and the Council of Obas Law as amended by the council of Oba Law 2005. However, it has been held that the 1st defendant’s appointment was not valid in law and he is not the Baale of Ososun’
‘Hence, his appointment was not valid in law and that he is not Baale of Ososun, hence, his appointment as coronet cannot be valid since his appointment as Baale of Ososun was not in accordance with the native law and custom’
‘It is the law that if act is void then it is in law a nullity, It is not only bad but incurably bad. You cannot put something on nothing, it will collapse. In the circumstance, issue (111) is hereby resolved in favour of the claimant’, the judge declared
Penpushing also reports that the court in the judgement declared order of perpetual injuction restraining the first defendant, Chief Hezekiah Solanke from parading himself as Oba or Kabiyesi in Ogun State
