COURT SACKS IFEANYI UBAH AS SENATOR

The latest order was given in the suit filed by Obinna Uzoh challenging Ifeanyi Ubah’s victory on the grounds that he (Ubah) allegedly presented a forged National Examination Council (NECO) certificate to the electoral commission.

Penpushing further reports that, the lawmaker, however, approached the court to set aside the judgment on grounds that he was neither given fair hearing nor served with the court process and hearing notice in the suit before the court delivered the judgment against him.

However, on December 4, the judge  ordered a stay of execution, restraining Senate President Ahmad Lawan from swearing in  Uzoh, pending the hearing and determination of the motion challenging the verdict.

Penpushing also reports that, the judge during the resumed court session on Friday, held that Ubah’s application to vacate its judgment lacked merit, and accordingly dismissed it, while in another motion brought byUba, claimant to the Peoples Democratic Party(PDP) Senatorial ticket, seeking to be joined as an interested party in the substantive suit marked CV/3044/2018, was also dismissed.

The sacked Senator, in reaction declared that he remains the Senator representing Anambra South “because the election petition tribunal and the appeal court had affirmed his election”,arguing that the case at the Federal Capital Territory(FCT) High Court is a pre-election matter that the court has no jurisdiction over, stressing that  he also said he will appeal against the judgment.
