Court dismisses suit against oshiomhole

The  Federal Capital Territory (FCT) High Court sitting  in Jabi, Abuja, the Federal Capital Territory(FCT) has  dismissed a suit filed against the former chairman of the All Progressives Congress (APC) Adams Oshiomhole), and three others.

Penpushing reports that, the National Vice-Chairman of All Progressives Congress(APC), North-East, Mustapha Salihu and five others had on January 16 through their lawyer, Oluwole Afolabi filed the suit arguing that  Oshiomhole should not be regarded as the party  national chairman since he was suspended by the Edo State chapter of the party.

The trial judge, Justice Danlami Senchi on March 4, granted an interim order suspending  Oshiomhole from further acting as the  National Chairman of the ruling party pending the hearing of the main suit.

Penpushing further reports that, the former party chairman then approached the Court of Appeal to challenge the lower court’s order, and on. June 16,  the higher court upheld the suspension of Oshiomnole as the party national chairman

The plaintiff’s lawyer, at the resumed hearing of the substantive suit on Thursday, informed the court that he had filed a motion on notice dated July 1, seeking to withdraw the case against the respondents.

Penpushing also reports that, the counsel said the withdrawal was informed by the directive by leaders of the All Progressives Congress (APC) that all court cases be discontinued in the interest of peace.

The counsel to Oshiomhole, Ginika Ezeoke, did not oppose the application for withdrawal, and consequently Justice Senchi dismissed the suit and ordered parties to bear their respective costs.

Penpushing recalled that, the National Executive Committee (NEC) of the All Progressives Congress(APC) had dissolved the national working committee  and appointed a caretaker committee under the leadership of Governor Mala Buni of Yobe State, with the National Executive Council(NEC) directing that all suit in court should be withdrawn.
