Adegoke’s murder: Court strikes out case for further investigation

The High Court of the Federal Capital Territory (FCT), sitting in Gudu, in Apo, Abuja, has granted the prayers of family of Timothy Adegoke, a postgraduate student of Obafemi Awolowo University, Ile-Ife to withdraw the case, necessitating further investigation into the case.

Penpushing reports that, the prosecuting counsel, Ochogwu Ogbe, had on Tuesday moved an application for discontinuance of the murder case in view of some new facts found concerning the case.

The prosecutor representing the police team, in the court filings explained that the withdrawal of the case was necessitated by the need for further investigations on the case, stressing that this was as a result of new facts which emerged on the case.

Penpushing further reports that, the Judge, Justice Modupe Osho-Adebiyi in her ruling based on the application, struck out the charges filed in connection with the murder, explaining that this became necessary since the prosecutor applied for a discontinuance of case and the defendants are not opposing the application,

The ruling, however, came as a temporary reprieve for the seven defendants, including Rahmon Adedoyin, the owner of Hilton Honour Hotel and Resorts, Ile Ife, where Adegoke was reportedly murdered in November, 2021.

Penpushing also reports that, as at the time of filing this report, it was not clear if the police would release the defendants during the period of further investigations, while it is on record that, the police decision to withdraw the charges came on the heels of the request by the Adegoke family lawyer, Femi Falana’s request for the case to be transferred to Ile Ife in Osun State, where the alleged offences were said to have been committed.
