Transporter drags Nigeria Police to court over infraction of fundamental human rights

A Transporter has filed a civil suit at the High Court in Abeokuta, Ogun State Capital against the defunct Special Anti-Robbery Squad (SARS) of the Nigeria Police for infraction on fundamental human right

Penpushing reports that, in the suit number AB/483/19 Y.K. Ololade Nigeria Limited alleged that its Scania Truck with registration number LND 343 XP was wrongfully and illegally detained by the Special Anti-Robbery Squad (SARS) at their Obada-Oko Zonal command without any criminal offence.

The plaintiff in the suit added that, the action of the Special Anti-Robbery Squad(SARS), therefore, constitutes an infraction of the company’s fundamental right guaranteed under Section 44(1) of the Constitution of the Federal Republic of Nigeria.

Penpushing further reports that, the originating motion filed by the Chambers of Gani Ogunsanwo in Abeokuta, the applicant is seeking for an order of the court to direct the Assistant Inspector General of Police, Zone II, Lagos, the Ogun State Commissioner of Police, VSP Gbenga Megbipe, former commandant, Zonal Intervention Anti-Robbery Squad (SARS), Obada Oko and one Ade Balogun to jointly and severally pay a total sum of N6,000,000.00  compensation for wrongful and unconstitutionally arrest and detention of the truck.

The applicant also seeks an order for the respondents to pay general damages at the rate of N500, 000.00 per week for estimated loss of business profit since August 10, 2019 that the truck has been held till the date of judgement.

Penpushing also reports that, the court is also requested to order the release of the truck to the owner, while hearing on the case is adjourned till 3rd December,2020.
