Again, Buhari jets out for 2 weeks medical check up without transmitting power to Osinbajo

The President of Nigeria Muhammadu Buhari, is again set to travel out of the country for about two weeks, for medications, and he is expected to depart Nigeria for Kenya on a three-day official visit and thereafter will proceed to London.

Penpushing reports that, the Presidency made this known on Tuesday but silence on whether Buhari transfer power to the Vice President, Prof Yemi Osinbajo on an interim basis as constitutionally expected.

The Presidency in its statement on Tuesday, also kept mute on details of the medical checks the President will undergo in London or whether or not it will affect the discharge of his duties, while outside the country for the said period.

Penpushing further reports that, the country constitution provides that when the President is going on vacation or is unable to discharge the functions of his office, he will notify the National Assembly and temporarily transfer power to his deputy.

“WHENEVER the President is proceeding on vacation or is otherwise unable to discharge the functions of his office, he SHALL transmit a written declaration to the President of the Senate and the Speaker of the House of Representatives to that effect, and until he transmits to them a written declaration to the contrary, the Vice-President shall perform the functions of the President as Acting President,” Section 145(1)(2) of the Nigerian Constitution states

Penpushing also reports that, it is recalled that, during inception of  Buhari administration, he  used to notify the National Assembly of such medical trips and temporarily hand over power to, Prof Yemi Osinbajo who constitunaly his Deputy .

The record, however, has it that, the last time  Buhari handed over to the Vice President  while embarking on personal (medical) trips was in 2018, while it is also on record that he  has embarked on many such trips since then, and  avoided formally notifying lawmakers and transferring power to his Deputy.
